These Terms and Conditions ("Terms") govern your access to and use of our website (https://www.certifiedrealestatephotographer.com/), services, and any related digital content, applications, or tools (collectively, the "Service"). By accessing or using the Service, you agree to comply with and be bound by these Terms.
Please read these Terms carefully. If you do not agree with these Terms, you may not access or use the Service.
1. Acceptance of Terms
By creating an account, purchasing a course, subscription, or using any part of the Service, you acknowledge that you:
- Accept and agree to these Terms and our Privacy Policy.
- Have the legal authority to enter into a binding agreement.
- Are at least 18 years old, or, if you are under 18, you are using the Service under the supervision of a legal guardian.
2. Description of Services
The Certified Real Estate Photographer Course provides comprehensive training, resources, and tools designed to help users succeed in the real estate photography industry. This includes educational modules, downloadable resources, templates, and other supporting materials.
3. User Accounts
To access certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to keep your account information up to date.
You are solely responsible for maintaining the confidentiality of your account credentials and for any activity that occurs under your account. You must notify us immediately of any unauthorized use of your account.
4. User Conduct
By using the Certified Real Estate Photographer Course website and Service, you agree to comply with all applicable laws and regulations and to use the website in a lawful, responsible, and respectful manner. You agree not to:
- Use the website or Service for any illegal, unauthorized, or unethical purpose.
- Violate any local, state, national, or international laws or regulations while using the Service.
- Harm, abuse, harass, threaten, intimidate, or otherwise mistreat any other user of the Service or any Certified Real Estate Photographer Course staff.

- Infringe upon or violate the intellectual property rights of Certified Real Estate Photographer Course or any third party, including copyrights, trademarks, or other proprietary rights.
- Upload, post, or transmit any content that is illegal, offensive, defamatory, obscene, or otherwise harmful to others or violates the rights of others.
- Use the website to distribute unsolicited or unauthorized advertising, spam, or other forms of solicitation.
Violation of any of the above may result in the immediate suspension or termination of your account, and we reserve the right to pursue any legal remedies available under applicable law.
5. Subscription Plans and Billing
The Certified Real Estate Photographer offers various services and products, including courses and additional resources.
Course Purchases:
- One-Time Payment: For our courses, you will be required to make a one-time payment upfront. This payment grants you lifetime access to the course materials. Once the payment is processed and access to the course is granted, refunds will not be issued.
Subscription-Based Services:
- Automatic Renewal: For certain subscription-based services, you authorize us or our third-party payment provider to automatically renew your subscription at the end of each billing cycle. You will be charged the applicable subscription fee to your payment method on file. By subscribing, you agree to the pricing and payment terms presented during the signup process.
- Cancellation: You can cancel your subscription through your account settings. If canceled, your access to the subscription-based service will continue until the end of the current billing period. See our full Cancellation and Refunds section below.
Payment and Charges:
- You authorize us or our third-party payment provider to charge the applicable subscription fee to your payment method on file.
- If your payment fails, we may suspend or terminate your access to the Service until the outstanding fees are paid.

6. Cancellation and Refunds
Course Products and One-Time Payments
No Refund Policy
All sales for course products and services requiring a one-time payment are final. Once access to the course has been granted, no refunds will be issued, regardless of usage or completion status.
Subscription-Based Services
Cancellation
You may cancel your subscription to any of our subscription-based services at any time through one of the following methods:
- Access the account settings page in your account dashboard and submit a cancellation request.
- Contact Billing Support via email at [email protected].
Your subscription will remain active until the end of the current billing cycle, and charges will continue through that period. Cancellations are not prorated; therefore, no refunds will be issued for any unused portion of the current billing cycle. To avoid being charged for the next billing cycle, you must submit your cancellation request at least five (5) days before your next billing date.
Upon cancellation, we reserve the right to delete any data associated with your subscription, including saved content, marketing materials, or project files.
Refunds
For annual subscriptions paid upfront (without a trial period), we offer a 30-day money-back guarantee. If you request cancellation within the first 30 days from the original purchase date, you may be eligible for a full refund. No refunds will be issued for cancellation requests made after the 30-day window or for annual subscriptions canceled after renewal.
If your subscription includes a free or discounted trial period:
- If you cancel before the trial period ends, you will not be charged.
- If you do not cancel before the trial period expires, your payment method on file will be automatically charged for the full price of the selected plan on the day the trial period ends.
- No refunds will be provided if you fail to cancel your subscription before the trial period ends.

General Refund Policy
Refunds cannot exceed the total payment amount received for the applicable subscription. Refunds will not be issued for any failure to cancel a subscription on time, for unused portions of a billing cycle, or for cancellations made outside the specified refund windows.

7. License and Use of Content
Upon purchase, the Certified Real Estate Photographer Course grants you a non-exclusive, non-transferable, limited license to use the Content solely for your personal or professional real estate photography purposes.
Prohibited Uses
You may not:
- Resell, redistribute, or share the Content with third parties outside of your organization.
- Modify or create derivative works of the Content for resale or redistribution.
- Use the Content in any way that violates local, state, national, or international laws, or infringes on the intellectual property rights of others.
8. Lifetime License
We may, at our sole option, offer customers one or more pricing plans under a "Lifetime License." The term "lifetime" refers to the duration of the Certified Real Estate Photographer Course platform or service offering in its current form as of the date of purchase. "Lifetime" does not refer to the lifetime of the purchaser.
- Under a "Lifetime License," you are granted continued access to the Service for as long as we offer and maintain it.
- We reserve the right to provide free updates at our discretion, but major upgrades or new releases may require additional purchases.
- We also reserve the right to alter pricing structures, decommission the platform, or establish an "end of life" date for the platform.
- We may also limit certain features or functionality of the Service under a "Lifetime License," including access to third-party tools or services (e.g., OpenAI or other integrated services).
- LIFETIME ACCESS MAY BE REVOKEDÂ if you violate any terms or misuse the Service.
9. Ownership and Intellectual Property
All Content, including templates, scripts, and other materials provided through the Service, are the exclusive property of Certified Real Estate Photographer Course or its licensors and are protected by copyright, trademark, and other intellectual property laws.
You agree not to modify, distribute, reproduce, or create derivative works from any of the Content, except as expressly permitted by these Terms.
10. Third-Party Tools and Services
The Service may integrate or link to third-party tools, services, or platforms (e.g., email marketing providers, social media platforms). Your use of these third-party services is subject to their terms and conditions. Certified Real Estate Photographer Course is not responsible for the availability, content, or performance of any third-party services.
11. Commitment to Accuracy and Transparency
At Certified Real Estate Photographer Course, we are committed to delivering high-quality, reliable, and valuable marketing content to our users. Our goal is to ensure that the materials provided through our platform meet the professional standards expected by real estate professionals. We strive for accuracy in all the content we provide, but we also believe in transparency when it comes to how this content is created.
AI-Generated Content
Some of the content available on our platform, including text, images, and other digital materials, may be generated or assisted by artificial intelligence (AI) technology. While this content undergoes thorough review and editing by our team to ensure quality and relevance, it is important to note that AI-generated content may not always reflect the latest legal or industry-specific standards.
We recommend that users carefully review and, where necessary, modify any AI-generated content to ensure it aligns with their specific business needs, complies with local real estate regulations, and accurately represents their brand.
12. User Responsibility

Real estate laws, marketing regulations, and licensing requirements vary by region. 13. International Users
The Service is controlled, operated, and administered by Certified Real Estate Photographer Course from our offices within the USA. We make no representation that the Service or Content is appropriate or available for use in other locations. If you access the Service from outside the USA, you are responsible for compliance with all local laws and regulations, including any export restrictions.
You agree not to use or access the Content or Service in any country or jurisdiction where such use would violate local laws, including countries under embargo by the United States or jurisdictions where local sanctions apply.

16. Limitation of Liability

- Your use of or inability to use the Service.
- Any unauthorized access to or use of our servers and/or any personal information stored therein.
- Any interruption or cessation of transmission to or from the Service.
In no event shall Certified Real Estate Photographer Course’s total liability exceed the amount you have paid to us in the past three months for the specific service giving rise to the claim.
17. Indemnification
You agree to indemnify, defend, and hold harmless Certified Real Estate Photographer Course, its owners, officers, directors, employees, shareholders and agents from and against any claims, liabilities, damages, losses, or expenses arising out of or in any way connected with your use of the Service or violation of these Terms.
18. Changes to Terms
We may update these Terms from time to time at our sole discretion. We will notify you of any material changes via email or by posting the updated Terms on our website. Your continued use of the Service after the changes take effect will constitute your acceptance of the revised Terms.
19. Force Majeure
Certified Real Estate Photographer Course (“we,” “us,” or “our”) shall not be held liable for any failure or delay in performance, including but not limited to the delivery of services, access to course materials, or any obligations under these Terms, when such failure or delay arises from causes beyond our reasonable control. These causes include, but are not limited to:
- Acts of God (e.g., natural disasters, earthquakes, floods, hurricanes)
- Fire, explosions, or other catastrophic events
- War, invasion, or acts of terrorism
- Government orders, laws, or regulations (including but not limited to restrictions, lockdowns, or quarantine measures)
- Strikes, labor disputes, or industrial actions
- Internet outages, telecommunications failures, or disruptions to third-party services
- Pandemics, epidemics, or public health emergencies
In the event of a Force Majeure, we will make reasonable efforts to mitigate the impact of the delay or disruption and resume performance as soon as practicable. If the Force Majeure event continues for an extended period, we reserve the right to modify or suspend the affected services or obligations.
This provision does not excuse your obligation to pay any fees due under these Terms.
20. Governing Law and Jurisdiction
These Terms and any disputes arising from them shall be governed by and construed in accordance with the laws of the State of Texas, Grayson County, without regard to its conflict of law provisions.
Any legal suit, action, or proceeding arising out of, or related to, these Terms or the Site shall be instituted exclusively in the federal courts of the United States or the courts of the State of Texas, in each case located in the County of Grayson, although we retain the right to bring any suit, action, or proceeding against you for breach of these Terms of Use in your country of residence or any other relevant country. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.
